Agreement to Terms

By downloading, installing, or using HiFi Control ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Software.

Description of Service

HiFi Control is a Windows application that provides control functionality for various HiFi audio devices including BluOS, HEOS, and streaming services such as Spotify and Tidal. The Software allows users to control volume, manage inputs, and interact with their audio equipment through keyboard shortcuts and system tray integration.

License Grant

Free Version

The free version of HiFi Control grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Software for personal, non-commercial purposes, subject to these Terms.

Paid License Tiers

Paid license tiers (Standard, Pro) grant you a non-exclusive, non-transferable, perpetual license to use the features available within that tier as described on our pricing page at the time of purchase. Your license is personal and may not be shared or transferred to another individual or organization.

Perpetual License

The perpetual license option provides lifetime access to all features available at the time of purchase within the specified development phase. Future phases may require additional purchase.

Restrictions

You agree not to:

• Copy, modify, or distribute the Software except as expressly permitted
• Reverse engineer, decompile, or disassemble the Software
• Remove or alter any proprietary notices or labels on the Software
• Use the Software for any unlawful purpose
• Share, sell, or transfer your license to another party
• Use the Software in a way that could damage, disable, or impair our services
• Attempt to gain unauthorized access to any systems or networks connected to our services

Third-Party Services

HiFi Control integrates with third-party services and devices. Your use of these integrations is subject to the respective terms of service and privacy policies of those third parties:

• BluOS: Subject to Bluesound's terms and conditions
• HEOS: Subject to Denon/Marantz's terms and conditions
• Spotify: Subject to Spotify's Terms of Service
• Tidal: Subject to Tidal's Terms of Service

We are not responsible for the availability, functionality, or policies of these third-party services.

Payment and Billing

One-Time Purchases

HiFi Control licenses are sold as one-time perpetual purchases. You will be charged once at the time of purchase. There are no recurring charges unless you separately purchase an upgrade to a future phase or tier.

Refunds

We offer a 14-day money-back guarantee for first-time subscribers. If you are not satisfied with your subscription, contact us within 14 days of your initial purchase for a full refund. Subsequent renewals are non-refundable.

Price Changes

We reserve the right to modify pricing at any time for new purchases. Existing license holders are not affected by price changes to the tier they have already purchased.

EU Consumer Rights

If you are a consumer residing in the European Union, you have a statutory right to withdraw from your purchase within 14 days of the transaction date without giving any reason, provided you have not yet downloaded or activated the Software. Once you have downloaded or activated the Software, you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal. This does not affect your statutory rights under applicable EU and national consumer protection law, which cannot be excluded or limited by these Terms.

Intellectual Property

The Software, including all content, features, and functionality, is owned by HiFi Control and is protected by international copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Software will be uninterrupted, error-free, or free of harmful components. We make no guarantees regarding the compatibility of the Software with your specific audio equipment.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law, including mandatory consumer rights under EU law.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HIFI CONTROL, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SOFTWARE.

Equipment Damage Disclaimer: HiFi Control is not liable for any damage to your audio equipment, speakers, amplifiers, or any connected devices that may result from the use of our Software. This includes, but is not limited to:

• Damage caused by volume levels set too high, including speaker driver damage, blown tweeters, or amplifier overload
• Equipment damage resulting from rapid or repeated volume changes
• Damage caused by incorrect input source switching or configuration
• Any electrical damage, overheating, or component failure in connected HiFi equipment
• Hearing damage resulting from unexpected volume changes or high volume levels

You are solely responsible for configuring appropriate maximum volume limits and ensuring that the Software settings are compatible with your specific equipment. We strongly recommend using the configurable maximum volume feature to protect your equipment and hearing.

Our total liability for any claims arising from these Terms or your use of the Software shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless HiFi Control and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Software or violation of these Terms.

Termination

We may terminate or suspend your access to the Software immediately, without prior notice, if you breach these Terms. Upon termination, your license to use the Software will immediately cease.

You may terminate your use of the Software at any time by uninstalling it and, if applicable, canceling your subscription.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Software after changes become effective constitutes acceptance of the revised Terms.

Dispute Resolution

In the event of a dispute arising out of or relating to these Terms or the Software, we encourage you to first contact us directly via our contact form to seek an informal resolution. If the dispute cannot be resolved informally within 30 days, either party may refer the matter to the competent courts as specified under the Governing Law section below. If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands. If you are a consumer residing in the European Union, you may also benefit from any mandatory provisions of the law of the country in which you are resident.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
